City gives nod to $1.2K sewer project
Eldorado City Council met Thursday in a special called meeting and voted to issue $1.2 million in certificates of obligation in order to carry out improvements to the city’s sewer lines.
The council has the option of raising sewer rates or increasing taxes in order to repay the money. A combination of rate increase and tax increase may also be used.
Tom Brown, an engineer with Nasmith Engineering, Inc. in Austin, was on hand for the meeting. He explained that the project would provide much needed system upgrades in several parts of town including: • The alley between South Oak and South Divide Streets extending north under Murchison Avenue to Warner Avenue. • Old Mertzon Road (between North Street and Liveoak) • West Brooks Avenue and the alley between alley and street and alley behind Park Lane and the alley between Park and North West Street • Lee Street • Alleys between North Divide Street and Northeast Main Street
The project also includes installing submersible pumps at the lift stations on South Cottonwood near the old Fisher Lease yard, on East Street and East Dorris Avenue, and at the intersection of Murchison Avenue and West Warner Avenue near the hospital.
The estimated cost of the projects is $1,198,025.
Answering a question from council member Stacy Haynes, Brown said that the lift stations would need to be upgraded first.
Among the options under consideration for repaying the loan is a $6.70 cent monthly increase to residential and commercial customers. Another option calls for increasing property tax rates in order to fund the city’s “interest and sinking” account from which payments could be made.
After deciding to issue the certificates of obligation, the council approved publication of three notices advertising for bond and grant counsel services, financial advisory services and engineering services. The notices (see notices on page 8 & 10) call for replacing 4,700 linear feet of existing 6-inch clay sewer lines with 8-inch gravity lines and rehabilitation of the three lift stations mentioned above.
The notices also include the possibility of pursing grants and financing for a third elevated storage tank, 8,800 linear feet of new 8-inch gravity sewer lines to 39 residences in three subdivisions outside the city limits. It was noted that the county is also pursuing a grant for the same three subdivisions.
While discussing the projects, Mayor John Nikolauk questioned Brown about the elevated storage tank. Brown said the city is very near to needing a new water tower. He said that such a tower would cost another $1.3 million.
City Secretary Carolyn Mayo then updated the council regarding the census and redistricting. She noted that there was not a sufficient change in the city’s population in the last ten years to require for redistricting.
Mayo then distributed a letter she had written to attorney Barney Knight with Knight & Partners in Austin regarding property disputes in the Sunrise Subdivision. The letter included 14 items related to the history of the subdivision.
Mayo also advised that the YFZ Ranch caught up on their wastewater and landfill bills with five separate checks.
She also noted that council members Dorothy Dacy, Stan Meador and Jon Cartwright signed up for re-election, with no others filing.
Thursday night’s meeting was presided over by Mayor John Nikolauk with council members Stacy Haynes, Stan Meador, Dora Bosmans, Jon Cartwright and Dorothy Dacy in attendance. Council member Richard Mendez was absent.
The next regularly scheduled meeting of the Eldorado City Council is slated for 6 p.m. on Monday, April 11, 2011 in the council chambers at City Hall.

Judge denies Dutson’s indigent status
District Judge Barbara Walther on March 15th denied an indigency request for Keith W. Dutson, Jr.
Dutson, was sentenced in November of 2010 to six years and prison and fined $10,000 after being found guilty of Sexual Assault of a Child by a Tom Green County jury.
He petitioned the court on January 3, 2011 for a free “Appellate Record” based on his status as an indigent. The judge’s ruling means that Dutson will have to find a way to pay the more than $25,000 fee for the records.
In her ruling, Judge Walther stated that Dutson failed to complete an Affidavit of Indigence that is required by law and added that the affidavit filed by Hudson did not meet the requirements of Article 26.04 of the Code of Criminal Procedures.
Meanwhile, the judge has yet to rule on Dutson’s motion that he be granted a new trial.
Nichols appointed as Special Prosecutor Eric Nichols was appointed on February 21st as Special Procecutor at the request of 51st District Attorney Stephen R. Lupton.
Nichols, who has successfully tried seven YFZ Ranch defendants is slated to prosecute Wendell Nielsen on three bigamy counts. Log of Warren Jeffs’ jail vistors released Reagan County Sheriff Jeff Garner on March 22, 2011, released a log of Warren Jeffs jailhouse visitors.

Among those visiting Jeffs in January and February of this year were his brother, Lyle Jeffs, YFZ defendant Wendell Nielsen and a businessman named John C. Wayman.
Jeffs legal wife, Annette B. (Barlow) Jeffs, was one of the final visitors to see Jeffs on Saturday, February 26th.
The FLDS prophet is reportedly not receiving visitors during the month of March except his attorney, according to Sheriff Garner.
Noticably absent from the list of visitors is Naomie Jessop, believed to be Jeffs’ favored wife. She was with him when he was arrested in 2006 during a traffic stop near Las Vegas, NV.
Naomie Jessop is also the woman who served as scribe and recorded many hours of Jeffs’ dictations while he was on the run from the law and listed as one of the FBI’s Ten Most WantedFugitives.
